Consumer?
A consumer is any person to whom a product is offered to
satisfy his personal/family needs or with whom a
contract is concluded to meet such end.
Supplier?
Any person who offers a product/service or produces,
exports, distributes, displays, circulates, trades, or
concludes transactions in relation to a product for the
purpose of offering to consumers or concluding in any
way a contract/transaction in relation to such product.
Product defect?
Any deficiency in the value/avail of a product,
depending on the purpose of such product, that totally
or partially prevents consumers from getting the benefit
for which this particular product was made. This applies
to defects resultant from moving or storing the product,
so long as the consumer is not responsible for its
occurrence.
Product replacement/returning conditions?
Unless the Agency determines a shorter period depending
on the nature of the product, a consumer may, within
fourteen days from receiving the product, replace/return
and refund the value of such product if it was found to
be defected or inconsistent with the standards or the
purpose for which the sale contract was concluded. The
supplier shall be obliged to replace or restore and pay
back the price of the product without any additions
costs.
The data that must be displayed included in the
invoice?
Name and commercial domicile of supplier; date of
transaction/contract; price, specifications, nature,
type, and quantity (number or weight) of the product;
date of the consumer’s receipt of the product; and
signature/stamp of supplier.
Importance of the invoice?
The invoice proves that a transaction or a contract was
concluded between the consumer and the supplier in
relation to a product or a service. Upon the request of
the consumer, a supplier must issue an invoice without
any extra charges. Receipts of automatic cahiers found
in stores shall be considered an invoice if it showed
the name of the supplier and the date of transaction.
Installed sale conditions?
In case a product is sold on installments, the invoice
must indicate the total amount of installed payments,
the annual interest rate and how it is calculated, the
date of applying the interest, the number of
installments and the value of each, the installment
period, and the procedures to be applied in case of
failure/delay of paying the installments.
Misleading and confusing advertisements?
A confusing or misleading advertisement is one that includes false
statement, claim, or any thing that directly or
indirectly creates a false/confusing impression about
the product’s nature; composition; origin; weight;
volume; method of manufacturing; production/expiry date;
directions of use; producer, provider of service and
place where such service can be obtained; contract terms
and conditions, including guarantees, aftermarket
services, price, payment method; trademarks, and product
specifications.
